Top court to ED: Don’t summon Kavitha till we hear her petition

Stating that it will have to further hear Bharat Rashtra Samiti (BRS) leader K Kavitha’s plea challenging the summons issued by the Enforcement Directorate to her in connection with the Delhi excise policy case, the Supreme Court on Tuesday asked the agency not to summon her till it takes up the matter next.

“We will have to hear the matter. In the meantime, don’t call her for questioning,” Justice S K Kaul, heading a two-judge bench, told Additional Solicitor General S V Raju who appeared for the probe agency.

On the last date of hearing on September 15, the ED had assured the court that it will defer the summons by 10 days.

On Tuesday, the counsel appearing for Kavitha sought to submit that there were restrictions on summoning women in PMLA offences and that they should be questioned at their residence.

But the court said: “You cannot say that a woman cannot be called for questioning at all, as a witness or in whatever capacity. There has to be some safeguards…”

The bench added: “there are cases of abuse of law, and there are cases of a different kind. So, there is no one common thread.”

The court will hear the matter next on November 20.
